Throughout these Terms & Conditions, “NurseryVerse”, “we”, “us”, or “our” refers to NurseryVerse. “You” or “your” refers to the customer or website user. These Terms & Conditions apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and contributors of content.

We reserve the right to update, change, or replace any part of these Terms & Conditions at any time. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

2. Online Store Terms

By agreeing to these Terms & Conditions, you represent that you are at least the age of majority in your province or territory of residence, or that you have given us your consent to allow any of your minor dependents to use this site.

You may not use our products for any illegal or unauthorised purpose, nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). You must not transmit any worms, viruses, or any code of a destructive nature. A breach or violation of any of these Terms will result in an immediate termination of your access to our services.

3. Products and Services

All products displayed on our website are subject to availability. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products, pricing, and product availability are subject to change at any time without notice, at our sole discretion.

We have made every effort to display as accurately as possible the colours and images of our products. However, we cannot guarantee that your device’s display of any colour will be accurate. We reserve the right to discontinue any product at any time.

4. Orders and Account Information

When you place an order on nursery-verse.com, you agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. In the event that we make a change to or cancel an order, we will attempt to notify you by contacting the email address provided at the time the order was made.

5. Returns and Exchanges

If you are not completely satisfied with your purchase, we offer a flexible returns policy within 15 days of receipt, subject to our return policy conditions. Returns are free when completed in a NurseryVerse shop. For online returns, a return request can be made through our website.

All returned goods must be in their original packaging, with labels attached, and in new condition to be eligible for any exchange or refund. Certain products are ineligible for return, including clearance items, assembled furniture, hygiene products, special orders, personalised products, and gift cards. 6. Price Adjustments

Price adjustments are limited to a period of 15 days following the date of purchase. To be eligible for a price adjustment, the item must be of the same brand and model number, and the lower price must be for an in-stock item available for sale at the time of request.

7. Defective Products and Warranty

If you receive a defective product, our team will assist you in resolving the situation. Please inspect the items as soon as you receive your order and contact our customer service department if you have received a faulty product.

Snowsuit breakage caused by a manufacturer’s defect is guaranteed for the duration of the current season. Only manufacturer’s defects are covered by this warranty, and NurseryVerse reserves the right to refuse to apply this policy at any time if the defect is deemed not to be a manufacturer’s defect. Warranties on baby items are honoured directly by the manufacturers.

8. Rewards Program

NurseryVerse offers a rewards program known as the Little Sprouts Program. By enrolling, you agree to the specific terms and conditions governing the program. Points are earned on purchases and can be redeemed for coupons. Points do not expire, but once converted into a coupon, the coupon is valid for 180 days. We reserve the right to modify, suspend, or terminate the program at any time, subject to applicable laws.

9. Gift Cards

Gift cards purchased from NurseryVerse are non-refundable and cannot be exchanged for cash. Protect your gift card like cash, as it cannot be replaced or reimbursed if lost or stolen. Gift cards are final sale and cannot be returned.

10. Prohibited Uses

In addition to other prohibitions as set forth in these Terms & Conditions, you are prohibited from using the site or its content for any unlawful purpose; to solicit others to perform or participate in any unlawful acts; to violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances; to infringe upon or violate our intellectual property rights or the intellectual property rights of others; to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; to submit false or misleading information; to upload or transmit viruses or any other type of malicious code; to collect or track the personal information of others; to spam, phish, pharm, pretext, spider, crawl, or scrape; for any obscene or immoral purpose; or to interfere with or circumvent the security features of the Service or any related website. We reserve the right to terminate your use of the Service for violating any of the prohibited uses.

11. Limitation of Liability

To the fullest extent permitted by law, NurseryVerse shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses arising out of or in connection with your use of the site or purchase of products.

12. Indemnification

You agree to indemnify, defend, and hold harmless NurseryVerse and our affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your breach of these Terms & Conditions or the documents they incorporate by reference, or your violation of any law or the rights of a third party.

13. Severability

In the event that any provision of these Terms & Conditions is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms & Conditions, such determination shall not affect the validity and enforceability of any other remaining provisions.

14. Termination

These Terms & Conditions are effective unless and until terminated by either you or us. You may terminate these Terms & Conditions at any time by notifying us that you no longer wish to use our services, or when you cease using our site. If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms & Conditions, we also may terminate this agreement at any time without notice, and you will remain liable for all amounts due up to and including the date of termination.

15. Entire Agreement

These Terms & Conditions constitute the entire agreement and understanding between you and NurseryVerse and govern your use of the Service, superseding any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms & Conditions).

These Terms & Conditions and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the province of Quebec and the laws of Canada applicable therein.
